General terms and conditions of sale

The present General Conditions of Sale (hereinafter referred to as " GTC ") shall exclusively govern the contractual relationship between the company Watch-Brussels, the headquarters of which is located at Rue des Capucins 8A, 1000 Brussels, and its customers (hereinafter referred to as the " Buyer ").

They take precedence over any general terms and conditions of purchase of the Buyer and, more generally, any document issued by the Buyer.

The online sale of the Products presented on the Site is open to the Buyers wishing to take delivery in the following countries : Belgium, France, netherlands.

1. DEFINITIONS
Buyer : means any natural person who is acting for purposes that do not fall within the scope of its commercial, industrial, craft, liberal or agricultural as well as any legal person who is not acting for professional purposes, you have created an Account and accepted these terms and conditions.

Account : refers to the account created by the Buyer via the Website HTTPS://WATCH-BRUSSELS.BE.

Order : refers to the Products ordered by the Buyer.
Personal data : means any information relating to a natural person that can identify you directly or indirectly.
Product : refers to the set of products offered for sale through HTTPS://WATCH-BRUSSELS.BE.
Price : means the price including tax (VAT) proposed by HTTPS://WATCH-BRUSSELS.BE for the covered Product, which may include various fees such as delivery charges.
Site : means the internet site of Watch-Brussels available at the address HTTPS://WATCH-BRUSSELS.BE

User : refers to any visitor to the Site, professional or individual, client or not HTTPS://WATCH-BRUSSELS.BE

2. OBJECT
These terms and conditions are intended to define the rights and obligations of the Parties in the framework of the sale of the Products offered by the company HTTPS://WATCH-BRUSSELS.BE to the Buyer.

They shall be communicated to the Buyer when the Order validation and are freely accessible to any user of the Site.

They are applicable as soon as they are online on the Site and are binding on to the Buyer upon acceptance.
They prevail over any other document, including all terms and conditions of purchase.
These terms and conditions do not relate to purchases made by Buyers located in Belgium, France, the netherlands and delivered exclusively on these territories.
WATCH-BRUSSELS reserves the right to modify time its terms and conditions.
WATCH-BRUSSELS will provide the Buyer with the latest version of the GTS on the Site and will provide him with a copy of this version, if the Buyer asks for it.

3. CUSTOMER ACCOUNT
Any Buyer wishing to place an order on the Site must have an Account.
In order to open an Account on the Website, the Buyer will provide certain information (first name, last name, company, mailing address and e-mail, phone number etc) and will be asked to choose a password.
The Buyer will receive a confirmation e-mail of WATCH-BRUSSELS, belgium contains the summary and confirmation of Account creation.
The password to the Buyer is as confidential as personnel and used under their sole responsibility.
Any action and/or a connection and/or Order made and/or grown with this password is deemed to be made by the Buyer. In case of loss of password, the Buyer must notify HTTPS://WATCH-BRUSSELS.BE without delay, and perform the procedure for changing the password provided on the Website.

4. ORDER

4.1 Order placed by the Buyer

All Orders must be made by the Buyer on the Site.
To place an order on the Website, the Buyer adds it to his shopping cart the Products he wishes to order.
By clicking on the " YOUR shopping CART ", a summary of its Command as well as the Prices with all taxes included (T. T. C) of the Product they wish to order will appear on the screen.
To Order, the Buyer will be asked to identify if it has not done so previously or, if it does not already have an Account, create one. In this last case, the Purchaser must inform its postal address and telephone number.
After logging in, the Buyer will have to fill in, if it has not previously listed, or if he wishes to change, its postal address and telephone. It will then indicate the country and the zip code in which he wishes to be delivered. It being specified that the Purchaser may specify a different delivery address than the billing one.
Depending on the designated Country, and postal code indicated, a number of delivery options will be available.
The Buyer will then pick the mode of delivery that he desires and depending on that choice, the total Price of their Order will appear on the screen.

It will then select the payment method that he desires and a summary of the Order will appear on the screen.
The Buyer will then need to proceed to the payment of his Order and then click on the icon of validation to finalize the Order.
The "click to enable" constitutes an electronic signature.
This electronic signature has, between the parties, the same value as a handwritten signature.
Just click validation constitutes an irrevocable commitment of the Buyer which can not be questioned.
As soon as the Order is confirmed, Watch-Brussels address the Buyer by e-mail to the address provided by the latter, a summary of their Order.
The Buyer has access, from his Account, the history of its control and may in particular take the course (preparation, delivery etc).
4.2 Modification of the Order

The Buyer has the possibility, before the shipment of the Order, to modify his Order.

If the Command is in course of preparation, he will then have the opportunity to change it. Once an Order is modified, it will receive an e-mail of Watch-Brussels summarizing its modified Command.
In the case where the amount of the modified Command would be lower than the initial Order, Watch-Brussels will reimburse the difference to the Buyer within a period of fourteen (14) days following the change of Command.
In the case where the amount of the modified Command would be higher than that of the initial Order, the Buyer shall make payment of the difference in the same conditions as those laid down for the initial Order.
The modification of the Order will receive a confirmation e-mail by Watch-Brussels, sent to the e-mail indicated by the Buyer during the validation of the modified Command.

4.3 Refusal of Order

The company Watch-Brussels reserves the right to refuse any Order in the event of :
– Exceeding the limits of Command indicated ;
– Existing dispute with the Buyer ;
– Non-total or partial payment of a previous Order by the Buyer ;
– Refusal to authorize payment by credit card payment organisations ;
– Abnormal character of the latter, in particular, in the case of Orders for specific quantities and/or amounts that are unusual for a consumer.

5. PRODUCTS
  5.1 Product Information
The information contained in catalogs and electronic media miscellaneous (electronic documentation, interactive catalog, Website, newsletter, notice of the direction, instruction and promotional materials) are the most accurate as possible but are given only as an indication and may be modified at any time and without notice.
The photographs illustrating the Products on the Website are not part of the contractual field. Also, the responsibility of HTTPS://WATCH-BRUSSELS.BE shall in no case be held responsible for errors or alterations resulting from the processing of these photographs are introduced.

5.2 Availability of the Product
The Products are offered on the Website within the limits of available stocks.
In case of unavailability of the Product ordered by the Buyer, Watch-Brussels will inform the Buyer as soon as possible and will tell him, if this is possible, the date on which the Product will be available again. The Buyer will then have the opportunity to get the refund for the unavailable Product, proceed to the modification of its Order or, if the time limit is submitted, wait for the Product is available again.
Being specified that in case of cancellation of the Order for the Product in question, the Buyer will be refunded the value of this Product by Watch-Brussels.
6. PRICING AND BILLING
The prices are expressed in euros and are, unless otherwise stated, all taxes included (T. T. C).
If the Buyer does not provide a number of value-added tax (hereinafter " VAT ") intra-community VAT is charged by Watch-Brussels, according to the tax provisions in force on the date of the invoice. It being specified that the VAT is that of the country of delivery of the Product.
For orders placed in Switzerland, the price is expressed and calculated excluding taxes (VAT).
Prices are subject to change at any time by Watch-Brussels.
The guaranteed price to the Buyer is posted on the Site at the time of placing the Order.
The prices indicated do not include participation in the delivery charges, which will be charged separately and are shown in the Order confirmation and the invoice sent to the Buyer.
They are also not any other additional costs (gift wrapping, etc).

The Buyer agrees to pay the stipulated Price for the Product ordered on the Site and its potential costs (transportation) as well as to set or adjust, if necessary, directly to the freight forwarder or carrier, customs duties, VAT or other taxes due at the time of the importation of the Product into the country of the place of delivery and, in particular Switzerland and territories and overseas departments.

Once the Order is confirmed, Watch-Brussels offers the Buyer an invoice of the Order freely available on his Account.
Given that when the delivery is carried out outside metropolitan France, a paper copy of this invoice will be provided to the Buyer upon the delivery of his Order.

7. PAYMENT METHODS
The Order is the order with obligation of payment, the placement of the Order involves a cash payment from the Buyer.
The regulations can only be made online by credit card, stripe or Klarna. through a secure system that uses the SSL protocol (Secure Soket Layer) so that the information transmitted is encrypted by software and no third party can read it during transmission on the network.
The payment of the Order may not in any case be subject to any set-off with the eventual amount due by Watch-Brussels to the Buyer.
The flow rate of the bank card will take place following the validation of the Order. It is stipulated that in the event of split delivery of the Order, the amount of the Order will be fully charged when its validation.

8. DELIVERY

8.1 delivery Times

Delivery times are indicated in the page " Shipping ".
They are counted in business days from the date of validation of the Order when the address of the Command has been correctly completed.


Given that for delivery in these countries, customs fees may be impacted to the Buyer. The amount of these duties shall be fixed by the customs authorities and that Watch-Brussels may in no case be held responsible for the payment of this fee when sending the Order to the Buyer, the regulation of this tax should have been paid by the Buyer in order that he may receive his / her Order.

No refund or any other compensation, will not be asked to Watch-Brussels by the Buyer due to the lack of delivery due to non-payment of this tax by the Buyer.

8.2 delivery Terms and conditions
Delivery means the transfer to the Buyer of the physical possession or control of the Product.
The ordered Products will be delivered to the address indicated by the Buyer when Ordering. The Buyer will have to ensure its accuracy.
Any parcel returned to Watch-Brussels due to a delivery address that is inaccurate or incomplete, or where the Buyer has not withdrawn his / her Order from the pickup point he had indicated, in the time that has been allotted, will be reshipped at the Buyer's expense. Given that the costs of the return will be communicated by Watch-Brussels to the Buyer and may differ from the initial shipping charges to which the Purchaser would have been able to benefit from reduction.
The delivery costs are the responsibility of the Buyer and are reported at the choice of the mode of delivery of his Order.
The carrier's delivery receipt is signed by Buyer, shall constitute proof of delivery of the Product.
Except in cases of force majeure or during periods of closure clearly announced by Watch-Brussels Products are shipped within seven (7) days following the date of registration of the Order, as indicated on the e-mail summary of the Command sent to the Buyer.
The risk of loss or damage is transferred to the Buyer upon delivery of the goods to the carrier.
In case of exceeding the indicated time period, or, in default, beyond 30 days after the conclusion of the Order, the Purchaser may terminate the contract of sale with the WATCH-BRUSSELS under the conditions laid down in article L. 138-2 of the consumer Code, if, after written request of the Buyer e-mailed to WATCH-BRUSSELS at the address SET The e-MAIL ADDRESS, it has not delivered the Product in a reasonable additional period of time.
The Purchaser may immediately terminate the contract if WATCH-BRUSSELS were to refuse to deliver the goods or if it did not perform its obligation of delivery of the goods within the additional reasonable and that the date or time specified is an essential condition of the contract having been brought to the attention of WATCH-BRUSSELS during the Ordering process.
In the case of a contract resolution, WATCH-BRUSSELS will reimburse the Products have not been delivered, and fees associated with the Buyer within 14 (fourteen) days following the date of resolution of the contract.
It is up to the Buyer to verify at the time of delivery of the Products ordered and including the quantity, quality, weight, dimensions, content, compliance and condition of the Product. If it finds any abnormalities, he shall issue, upon delivery to the carrier, the handwritten notes, detailed and dated, describing the defects. These reserves should also be addressed to WATCH-BRUSSELS, within twenty-four hours (24) hours by e-mail contact@watch-brussels.be) with reference to the order number, accompanied by photographs illustrating the defects.
In the absence of reserve expressed in these terms, the delivery shall be deemed to be in compliance.
The Buyer must keep the packaging and the delivery of the Product delivered. In the event of a mistake on the Product, the Purchaser may return the Product concerned in accordance with the terms and conditions described in article 13.

9. RESERVATION OF TITLE
The transfer of ownership of the Product takes place only after receipt of full payment of the Price.
In the event of default or delay payment of the Price, WATCH-BRUSSELS reserves the right to claim return of the Product delivered.
The Buyer agrees to return the delivered Product which is the payment fails, at its own expense, at the first request of WATCH-BRUSSELS.

10. GUARANTEES

10.1 commercial Warranty
The Products are declared to conform to the different standards in force by the Person responsible in accordance with the european Regulation n°1223/2009 on cosmetic Products.
The warranties on goods sold by WATCH-BRUSSELS are those given by the responsible Person, whose name and address appears on such goods. They are sent to the Buyer with the Product when delivered.

10.2 Warranty against hidden defects
Regardless of the commercial guarantee, WATCH-BRUSSELS warrants the customer against any hidden defects, from a design defect of the Product, to the exclusion of any negligence or fault of the Buyer, pursuant to articles 1641 and following of the civil Code below (reproduced).
The action in the warranty against hidden defects must be brought by the Purchaser within a period of two (2) years from the discovery of the defect.
The Buyer may choose between the rescission of the sale or a reduction of the selling price.
Article 1641 of the civil Code :
"The seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, yes that reduces the use that the buyer would not have acquired it, or would only have given a lesser price if he had known. ".
Article 1644 of the civil Code :
"(...) the buyer has the choice to make the thing and get a refund of the price, or keep the thing and make it a part of the prize, as it will be peer-reviewed by experts ".
Article 1648 paragraph 1 of the civil Code :
"The action resulting from latent defects must be brought by the purchaser within a period of two years from the discovery of the defect. ".

10.3 legal Guarantee of conformity

WATCH-BRUSSELS is also the guarantor, in respect of the Buyer, of the conformity of the Products, allowing him to make a request under the statutory warranty of conformity pursuant to articles L. 217-4 and following of the consumer Code (below reproduced).
The Buyer has a period of two (2) years from delivery of the Product to make its application under the statutory warranty of conformity. He must submit this request in writing, by registered mail with acknowledgement of receipt to WATCH-BRUSSELS.
The Buyer may choose between the repair or replacement of the property, subject to the cost conditions provided for by article L. 217-9 of the consumer Code.
In addition, in accordance with article L. 212-7 of the consumer Code, the Buyer is provided to prove that the non-compliance was present at the time of issuance if the fault occurs within twenty-four (24) months following delivery of the goods.
Article L. 217-4 of the consumer Code :
"The seller delivers goods in conformity with the contract and is liable for defects of conformity existing at the time of delivery.
It also responds to defects of conformity resulting from the packaging, instructions for assembly or installation when it was put to him by the contract or has been carried out under its responsibility. "
Article L. 217-5 of the French consumer Code :
"The property is in conformity with the contract :
1° If it is suitable for the use normally expected of a similar good and, where applicable :
– if it corresponds to the description given by the seller and possess the qualities that he has presented to the buyer as a sample or model ;
– if it has the qualities that a buyer can reasonably expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling ;
2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the knowledge of the seller and the latter accepted. ".
Article L. 217-12 of the consumer Code :
"The action resulting from lack of conformity is prescribed by two years from the delivery of the product. "
Article L. 217-16 of the consumer Code :
"When the buyer asks the seller, during the course of the commercial guarantee granted during the acquisition or repair of movable property, a reclamation covered by the warranty, any lock-in period of at least seven days, adding to the duration of the warranty left to run.
This period runs from the intervention request of the buyer or of the provision for repair of the property in question, if this is later at the request of intervention. "

11. THE ABSENCE OF SECURITY OF THE PRODUCT
In the event of damage caused by a safety defect in the Product, Purchaser must seek the liability of the responsible Person, whose name and address are mentioned on the packaging of the Product.

12. SUSPENSION – RESOLUTION.
In the case of non-performance by the Buyer of any of its obligations, in particular in case of total or partial default of payment on the due date, WATCH-BRUSSELS reserves the right, without prior notice, suspend the delivery of the Product under the Command executed or running and/or to suspend the performance of its obligations, without compensation, and without prejudice to the exercise of its rights of recourse.
In addition, if forty-eight hours after notice by registered mail with acknowledgement of receipt, it remains to be unsuccessful, all agreements entered into with the Purchaser will be terminated as of right, without the payment compensatory damages to the Buyer by WATCH-BRUSSELS, who may request, including interim relief, the return of the goods.
In all the cases mentioned above, and as soon as WATCH-BRUSSELS does not opt for the termination of the agreements, all claims not yet due, WATCH-BRUSSELS will become due immediately and the Buyer is obliged to immediately return the goods remained unpaid. The fact to WATCH-BRUSSELS does not avail itself of a breach of contract of the Purchaser shall not mean a waiver to invoke it for the future.

13. RIGHT OF WITHDRAWAL
In accordance with article L. 221-18 of the Consumer Code, the Buyer has a period of 14 (fourteen) days from the day of reception of the package containing the Products ordered, to exercise his legal right of withdrawal without having to justify its decision.
In accordance with article L. 221-28 of the Consumer Code, the right of withdrawal can not be exercised for orders containing :

• the supply of goods which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection,
• the supply of goods made to the consumer's specifications or clearly personalised (including services related to the workshop recording " cannot be the subject of the right of withdrawal).

These provisions shall apply without prejudice to the safeguards provided for in article 7 of these general conditions remain fully applicable.
The Buyer exercised his right of withdrawal under the conditions laid down in this article in terms of time and in terms of returning the products, will be able to obtain a refund the returned products as well as the delivery costs (at standard cost) of the order, in accordance with article L221-24 of the Code of Consumption. The refund will be made according to the payment method used for the initial transaction, unless expressly agreed to by the Buyer on another way of refund.

The return costs are at the expense of the Buyer.
The Buyer agrees to return the purchased Products in their original packaging and undertakes to take the utmost care when returning.
The Buyer is liable for any damage caused during the return and shall not claim any compensation.
In the case where the Buyer shall notify to WATCH-BRUSSELS of its intention to withdraw from the contract even before receiving the package, the Buyer is informed that it is not technically possible to WATCH-BRUSSELS block the shipment of the products once the order has been validated. The Order will then be shipped to the Buyer, and the Buyer agrees, in accordance with article L. 221-23 of the Code of Consumption, to return the affected products within a maximum period of fourteen (14) days after such information is made-to-WATCH-BRUSSELS.

General provisions applicable to all returns :

The products must imperatively be returned to WATCH-BRUSSELS in a clean state to a new marketing products in perfect condition, with their original packaging, accessories, instructions...) within fourteen (14) days from the date on which the Buyer has informed WATCH-BRUSSELS of its intention to withdraw and at the latest within fourteen (14) days following the date of receipt. Returns of items that are returned beyond this time will not be accepted.

If the Buyer has received on the Site of an offer versus purchasing, giving him the right, subject to conditions, to one or more product(s) offered(s) in consideration of the order and, as a result of the exercise of the right of withdrawal, the latter is no longer eligible for the offer in question; the Buyer must send the(s) product(s) they wish to return accompanied(s) of the product(s) offered(s) receive(s) in consideration of the order of the product(s) returned(s) to WATCH-BRUSSELS, to take into account its application for revocation.

The responsibility of the Buyer may be liable in the event of depreciation of the Product resulting from the handling other than what is necessary to establish the nature, characteristics and, where applicable, the proper functioning of the products.

The Buyer or recipient of the order that exercises his right of withdrawal must follow the following instructions :

• Use the original packaging for the return of the(s) Product(s) question(s),
• Return the(s) Product(s) question(s) at the address that will be provided, upon request, by contacting the customer service department (contact@watch-brussels.be)

If the Buyer or the recipient of the order does not show that he ensured that the deposit of the proceeds from a carrier, any risks related to the return of a Product are the responsibility of the Buyer or the recipient of the order.

IMPORTANT:
Les retours pour tout autre motif que le défaut de fabrication sont aux frais de l’acheteur. Il y a également une ouverture de dossier pour une expertise pour l’authenticité. Si le produit a été déballé, il n’est pas remboursé. Pour tout litige concernant une commande non reçue, le remboursement par la société de transport prend généralement 2-3 mois d’enquête indépendamment de notre volonté.
14. LIABILITY
All Products offered by WATCH-BRUSSELS must be used in accordance with their instructions for use and taking all the precautions that are necessary.
The Buyer assumes responsibility for the selection of the Product that he decided to order. Therefore, WATCH-BRUSSELS may in no case be held responsible for the inadequacy of the Product with the use made of it.
WATCH-BRUSSELS cannot be held responsible for any damage, direct or indirect, material or immaterial, resulting from the use of a Product in a manner not in accordance with instructions for use.
Outside of the cases mentioned above, the liability of WATCH-BRUSSELS, belgium may not be incurred if WATCH-BRUSSELS demonstrates that the failure or the improper performance of these Terms and conditions of Sale or the Command is attributable either to the Purchaser or to the unforeseeable and insurmountable fact of a third party to the contract.

15. FORCE MAJEURE
All circumstances independent of the will of the parties, preventing the performance in the normal conditions of their obligations, are regarded as grounds for exemption of the obligations of the parties and lead to their suspension.
The party that invokes the circumstances referred to above shall immediately notify the other party of their occurrence, as well as their disappearance.
Are considered as cases of force majeure to those usually retained by the jurisprudence, namely : the events with an irresistible and unpredictable, beyond the control of the parties, against which they have not been able to reasonably protect themselves and of which they would not have been able to recover from the consequences of engaging in expenses out of proportion with the expectations of financial returns.
In this respect, are considered so explicit as in the case of force majeure or fortuitous events the blocking of means of transport or of supplies, earthquakes, fires, storms, floods, lightning, the disruption of telecommunication networks or difficulties specific to telecommunication networks beyond the Buyers.
The Parties will come together to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the case of force majeure lasts for more than three months, the present GTC may be terminated by the injured party.

16. INTELLECTUAL PROPERTY
The content of the Website and all the elements that compose it, particularly in the form of text, photographs, images, icons, sounds, videos, software, database or data is the property of WATCH-BRUSSELS and is protected by international rules and the French intellectual property.
Therefore, any reproduction, representation, modification, transmission, publication, adaptation or exploitation of the elements on which WATCH-BRUSSELS has rights to intellectual property, on any medium and in any manner whatsoever, without prior written permission of WATCH-BRUSSELS, is strictly prohibited.
The reproduction or representation of non-substantial evidence on which WATCH-BRUSSELS has intellectual property rights are authorized for strictly private and non-commercial use.
Reproduction permitted for items on which WATCH-BRUSSELS has rights to intellectual property should be apparent in the source and the name of the author of the reproduced content.
WATCH-BRUSSELS reserves the right to exercise the legal proceedings civil and criminal, in France or abroad, including infringement, with respect to any person that, directly or indirectly, would have violated his or her rights.

17. PERSONAL DATA
During his Command, the Buyer may be asked to provide personal information.
WATCH-BRUSSELS applies in respect of the information submitted by the Buyer under the conditions laid down in the Policy of privacy and personal data.

18. NON-PARTIAL VALIDATION
If one or more stipulations of these general terms and conditions are declared invalid in application of a law, a regulation or following a final decision of a competent court, they will be deemed unwritten, without involving the validity of the whole of these GTC by which WATCH-BRUSSELS and the Buyer remain committed to one another.
In case of need, WATCH-BRUSSELS and the Buyer agree to negotiate in good faith the provisions necessary for the replacement of the stipulations which have been the subject of a cancellation or invalidation for any reason whatsoever.

19. MEDIATION

In the event of a dispute, the Buyer will have to apply in priority to the customer service of WATCH-BRUSSELS from Monday to Friday, except public holiday or holiday, from 10: 30 to 19: 00 by electronic mail to the e-mail address contact@watch-brussels.be

In the event of failure of the claim from the customer service department or, in the absence of a response from the service within a period of two months, the Buyer can submit the dispute relating to the purchase order or these terms and conditions between the WATCH-BRUSSELS the Ombudsman of the Federation of professional e-commerce and distance selling, which will, in full independence and impartiality, to bring the parties together in order to arrive at an amicable solution.

To submit a request for mediation, the Buyer has a complaint form available on the website of the ombudsman For details on how to complain to the Ombudsman, click here. The parties to the contract remain free to accept or refuse the use of mediation, as well as, in the case of recourse to the mediation, to accept or reject the solution proposed by the mediator.

20. NON-WAIVER
The fact that one of the Parties does not avail itself of a breach by the other Party to any obligations contained in these general terms and conditions shall not be interpreted for the future as a renunciation of the obligation in question.
The fact that a Party does not demand the application of any provision of these Terms and conditions of Sale or to tolerate the failure of a temporary or permanent basis, shall in no event be construed as a waiver by such Party to exercise any of the rights that it holds under these terms.
The fact that a Party of tolerating non-performance or imperfect execution of a contractual obligation referred to in these terms and conditions or, more generally, to tolerate any act, forbearance or omission of the other Party not in accordance with the contractual provisions do not confer any right to the party who has such a tolerance.

21. TITLE
The headings and sub-headings contained in these terms and conditions are included for your convenience. By express agreement between Watch-Brussels and the Buyer, these headings and sub-headings may not be used to interpret any provision of these terms and conditions. In case of contradiction between any of the titles of the articles and any of the clauses, the titles will be declared non-existent.

22. APPLICABLE LAW
These terms and conditions and the Order are governed in their entirety by the French law.
Any dispute relating to the conclusion, interpretation, execution or termination of these General Conditions of Sale will be subject to a search of an amicable agreement.
Any dispute which may arise between the Parties to the conclusion, interpretation or execution of these general terms and conditions of sale, shall be resolved exclusively by the competent Courts of Paris.
These terms and conditions are drafted in the French language. In the case where they have been translated into one or more foreign languages and in case of dispute, only the text written in the French language shall prevail between the Parties.

Shipping policy

We ship mainly with the following carriers : Colissimo Mondial Relay. The choice of the carrier is based on the client. 

Packages are generally dispatched within the 72 hours following the order. 

Your purchases may be sent in multiple packaging due to the format of certain products. You will follow the course of each parcel by tracking number.

Chez Watch-Brussels, nous nous engageons à fournir à nos clients des montres de marque de la plus haute qualité. Cependant, nous comprenons qu’il peut y avoir des cas où vous souhaitez retourner ou échanger un produit. Notre politique de retour est conçue pour rendre ce processus aussi simple et pratique que possible.

1. Conditions Générales de Retour :

• Les articles doivent être retournés dans leur état d’origine, avec tous les accessoires et emballages d’origine intacts.
• Les articles retournés doivent être dans un état non utilisé et ne pas présenter de signes d’usure.
• Les montres personnalisées ou gravées ne peuvent pas être retournées, sauf en cas de défaut de fabrication ou de non-conformité avec la commande.
• Les articles doivent être retournés dans les 7 jours suivant la réception de la commande initiale.

2. Processus de Retour :

• Pour initier un retour, veuillez contacter notre service clientèle par e-mail à l’adresse contact@watch-brussels.be ou par téléphone au +32 470 67 07 70
• Veuillez fournir votre numéro de commande et une brève explication du motif du retour.
• Notre équipe du service clientèle vous fournira un numéro d’autorisation de retour (RA) ainsi que des instructions détaillées sur la manière de retourner votre article.

3. Frais de Retour :

• Les frais de retour sont à la charge du client, sauf en cas de défaut de fabrication ou de non-conformité avec la commande.
• Nous vous recommandons d’utiliser un service d’expédition avec suivi pour retourner votre article, afin de garantir sa sécurité pendant le transport.

4. Remboursements et Échanges :

• Une fois que nous avons reçu et inspecté l’article retourné, nous procéderons au remboursement du montant total de l’achat, hors frais de livraison, selon le mode de paiement initial.
• Les remboursements seront traités dans les 5 jours ouvrables suivant la réception de l’article retourné.
• Si vous souhaitez échanger votre article contre un autre modèle ou une autre taille, veuillez contacter notre service clientèle pour obtenir de l’aide.

5. Garantie :

• Toutes nos montres de marque sont couvertes par une garantie du fabricant. En cas de problème avec votre montre après la période de retour, veuillez contacter le fabricant pour obtenir des instructions sur la réparation ou le remplacement.

La garantie ne couvre pas les situations suivantes :

• Une montre imprégnée d’eau
• Une vitre cassée
• Un bracelet endommagé ou détaché

Watch-Brussels propose un service de réparation à prix abordable tout en offrant une garantie de réparation d’un an. Cependant, cette garantie ne s’applique que pour les problèmes mécaniques. Les dommages résultant d’une chute ou d’autres causes ne sont pas pris en charge.

7. Cadeaux :
If the item was marked as a gift at the time of purchase and it was shipped directly to you, you will receive a credit for a gift of equivalent value to that of the returned item. Once the returned item is received, a gift certificate will be sent to you by post.
